Meaning of Terms in These General Conditions

The Terms of Business are governed by the Consumer Protection Act (N.N. 41/14, 110/15, 14/19), Chapter III – Distance Contracts, from Article 57 to Article 79.

  3. Buyer – any person who, after reviewing and selecting a product or service, has registered their details and placed an order for the product.
  4. User – any person using the website "https://www.crnjacboatservice.hr/" for the purpose of obtaining information about the content and/or purchasing the displayed products.
  5. Online Purchase or Web shop – purchasing products via the web shop "https://www.crnjacboatservice.hr/".

General Terms of Business

  1. The holder of all rights to the website https://www.crnjacboatservice.hr/ is Crnjac Boat Service d.o.o. It is assumed that consumers using the web shop "https://www.crnjacboatservice.hr/" are, at all times, familiar with these General Terms of Business (hereinafter: Terms) and fully understand and accept them.
  2. These Terms apply to the rights and obligations relating to the purchase of products or services via the web shop "https://www.crnjacboatservice.hr/" and to the rights and obligations arising from the conclusion of a Distance Sales Contract (hereinafter: Contract) between the consumer as the final buyer and the web shop "https://www.crnjacboatservice.hr/". The General Terms are considered an integral part of such contracts in terms of the conditions and manner of ordering products, product prices, payment methods, guarantees, complaints and returns, delivery, personal data protection, and other matters related to the use of the web shop "https://www.crnjacboatservice.hr/" and online purchases. Crnjac Boat Service d.o.o. reserves the right to amend these Terms of Sale and may do so without prior notice. All changes will be visible on the website "https://www.crnjacboatservice.hr/".
  3. The sales contract between the Buyer and the Seller is concluded at the time of the product order.
  4. Products ordered through the web shop "https://www.crnjacboatservice.hr/" will be delivered within Croatia via one of the courier services. For deliveries outside Croatia, packaging, delivery, and postage will be charged according to a quote prepared by Crnjac Boat Service d.o.o. and sent to the buyer. Please check the packaging when receiving the product because, in case of packaging damage that may indicate possible product damage, you must inform Crnjac Boat Service d.o.o., and request a written statement from the courier service regarding the observed damages, along with a report. Please do not open the packaging before contacting us! Upon delivery, the Buyer should check the package contents for all parts listed in the manufacturer's specification. In case of deficiencies, please inform us as soon as possible. The above delivery conditions only apply to Croatia. Delivery of ordered products abroad, if possible, occurs exclusively by prior arrangement. Delivery does not include the assembly and installation of ordered items.
  5. The Buyer must keep the warranty card and receipt throughout the warranty period. Repairs under the warranty are covered by an authorized service center of the manufacturer, who guarantees the functionality of the goods and the availability of spare parts even after the warranty expires.
  6. The Buyer can only be an adult, legally competent person. Contracts on behalf of minors or persons without full legal capacity may only be concluded by their legal representatives or guardians. Partially capable persons may conclude contracts only with the consent of their legal representatives or guardians. The Seller bears no responsibility for any actions contrary to this provision. A Buyer is any person who orders at least one product on the web shop "https://www.crnjacboatservice.hr/", fills in the required information, and pays for the ordered product. The recipient is the person to whom the product is delivered, and may be the same as or different from the Buyer. If the Buyer's information includes details of a legal entity, the buyer is considered to be the legal entity, and the person whose details were entered is considered the authorized representative of the Buyer.
  7. By accepting the general conditions of sale, the Buyer declares that all the information provided is true and complete, that they are legally competent, an authorized cardholder, and that there are no known obstacles to ordering and purchasing products through the web shop of Crnjac Boat Service d.o.o. Crnjac Boat Service d.o.o., in accordance with the privacy and data security statement, collects only the basic data necessary to fulfil its obligations. By accepting the general conditions of sale, the Buyer accepts all the conditions listed in these General Terms of Business and declares that all the information provided is true and complete, that they are legally competent, an authorized cardholder, and that there are no known obstacles to ordering and purchasing products.   8. Crnjac Boat Service d.o.o. is not responsible for any damages arising from the use of this web shop or the information on this website for purposes outside the intended use.
  9. The Seller has the right, without prior notice, to change the content of these General Terms, the product assortment, prices, and other information related to the web shop, as well as all other content on the website "https://www.crnjacboatservice.hr/", which is why users are obliged to familiarize themselves with its content during each visit to the website and read and understand the General Terms of Business. Any failure to comply releases the Seller from any liability. All changes made by Crnjac Boat Service d.o.o. to the website come into effect at the time of publication on the website "https://www.crnjacboatservice.hr/".
  10. The Seller disclaims any responsibility for the accuracy and/or completeness of all information and content on the website "https://www.crnjacboatservice.hr/". Crnjac Boat Service d.o.o. reserves the right to errors in the description and images of products, which are provided based on information received from the manufacturer.

Online purchases can only be made if the buyer provides purchase details on the website "https://www.crnjacboatservice.hr/", including Buyer information, delivery address, and payment method. When filling in the purchase details, the Buyer must provide accurate, valid, and complete personal data.

The Buyer is responsible for the accuracy and completeness of the entered data when filling in the form. These terms are part of the offer of Crnjac Boat Service d.o.o. for concluding the contract, and the user, as the buyer, accepts them by filling in the purchase details, completing the order, or in any other way provided by these Terms, which is considered to conclude a contract between the Buyer and Crnjac Boat Service d.o.o., under the sales conditions stated in these Terms.

 

Price

The products prices are retail. Prices of products and delivery costs are expressed in euros (EUR), including VAT.

The Seller reserves the right to change product prices without prior notice. The seller is also authorized, without prior notice, to set discounts, daily or weekly promotions, promotions for a specific product, group of products, and/or all products, as well as for a specific payment method.

 

Complaints

The customer has the right to return products in the following cases:

  • Delivery of products that were not ordered.
  • Delivery of products with defects or damage not caused by transportation.

Upon receiving the product, it is the customer’s responsibility to check the order's accuracy by comparing the received items with the invoice. If any item is missing or damaged, the customer must report this via email to This email address is being protected from spambots. You need JavaScript enabled to view it.. When reporting a defective product, the customer must include a copy of the invoice, warranty card, a description of the defect, and all associated documentation and original packaging. The warranty does not cover damages caused by improper handling, mechanical damage, lightning strikes, excessive voltage, or wear and tear of the device.

Upon receiving the purchased product, the customer must check the contents of the package for all parts listed in the manufacturer’s specification. In the case of visible material defects, Crnjac Boat Service d.o.o. must be notified as soon as possible, but no later than eight (8) days from the receipt of the product. Later complaints cannot be considered.

Product Inspection and Visible Defects: The customer must inspect the received product in the usual manner or have it inspected as soon as reasonably possible, and notify the seller of any visible defects within eight (8) days without delay, or they will lose the right to claim based on such defects. If the inspection is carried out in the presence of both parties, the customer must immediately notify the seller of any visible defects, or they will lose the right to claim.

The product, along with the original receipt, must be returned undamaged in its original packaging and in the same quantity with a written complaint stating the reason for exchange within 8 days from the date of receipt. Otherwise, the return will not be accepted. Return shipping costs are borne by the customer.

Crnjac Boat Service d.o.o. is not responsible for any product damage or other obligations that fall within the domain of the delivery service (the company performing the delivery).

 

Right to Cancel and Return

The customer has the right to terminate the contract in accordance with Article 74 of the Consumer Protection Act and must inform us via email at This email address is being protected from spambots. You need JavaScript enabled to view it. within 14 days from the date of the contract conclusion. The customer must inform Crnjac Boat Service d.o.o. of their decision to unilaterally terminate the contract before the deadline expires through an unambiguous statement sent by e-mail, stating their name, address, phone number, and email address.

If the contract is terminated after product delivery, the customer must return the product at their own expense, undamaged, with the original receipt and packed in the original packaging, within 14 days from the receipt of the product. The money for the paid product will be refunded within 8 days of receiving the product. The cost of the money return is borne by the customer.

In cases described in Article 79 of the Consumer Protection Act, the customer does not have the right to cancel the contract.

Online Dispute Resolution: As of February 15, 2016, a special European Union regulation allows for disputes related to online purchases across the EU to be resolved through the Online Dispute Resolution platform.
